Speaking with General Counsel Emily O’Neill on the Deminor Litigation Funding Podcast, Director Mohsin Patel discusses the constantly evolving nature of the litigation funding and litigation insurance markets.

Mohsin and Emily explore how the market for litigation funding has expanded over recent years to encompass a wide variety of funders covering a broad range of cases. As there is an entire spectrum of litigation funders, this market is able to cater for legal claims of all sizes and jurisdictions.

They suggest that the recent UKSC ruling in R (on the application of PACCAR Inc and others) (Appellants) v Competition Appeal Tribunal and others (Respondents) has proved an ‘unwelcome distraction’ for funders, and that this has led to a degree of reticence in litigation funding.

They conclude by discussing the characteristics of a good litigation broker, suggesting that a good broker will not only be able to help cut through the issues and ultimately get the deal to execution, but also maintain a good relationship with their clients as litigation often takes several years to complete.
